The Critical 24: What to Do in the First 24 Hours After a Texas Truck Accident

The 24 hours following a collision with an 18-wheeler are the most chaotic—and the most consequential—hours of your life. While you are trying to process the trauma, the trucking company is already executing a pre-planned defense strategy. I’ve seen it from the other side; they have investigators on the ground before the debris is even cleared from the highway. At Treviño Law, I use the first 24 hours to flip the script, ensuring my clients take the exact steps necessary to protect their health and their legal rights before the insurance company can interfere.
If you or a loved one has just been involved in a commercial wreck, follow this checklist immediately. These steps aren’t just suggestions; they are the foundation of your future recovery.
Your 24-Hour Emergency Action Plan
- Prioritize Immediate Medical Evaluation
Even if you “feel fine” or only have a dull ache, you must see a doctor immediately. Adrenaline masks severe injuries like internal bleeding or traumatic brain injuries (TBI). In the eyes of an insurance adjuster, a delay in treatment is an admission that you weren’t actually hurt. Ensure you provide a full account of the incident to medical staff, as these records become vital evidence. For guidance on identifying symptoms of late-appearing injuries, the Mayo Clinic’s TBI Overview is a critical resource. - Ensure a Formal Police Report is Filed
Never “work it out” privately with a truck driver. You need a formal peace officer’s crash report. In Texas, officers are required to file a CR-3 Crash Report for any accident resulting in injury or significant property damage. This document contains the officer’s initial assessment of fault and identifies the motor carrier’s DOT number, which I need to track down their safety history. - Document the Scene (If Physically Able)
If it is safe to do so, take photos of everything: the position of the vehicles, the skid marks, the debris field, and any visible logos on the truck’s trailer or cab. Look for “witnesses” that don’t have a heartbeat—specifically, look for dashcams on nearby vehicles or security cameras at nearby businesses. - Do NOT Speak to the Insurance Adjuster
This is the most common trap I see. Within hours, a “friendly” adjuster from the trucking company’s insurance carrier will call to “check on you.” They aren’t your friend. They are looking for you to say “I’m okay” or “I didn’t see him coming.” Anything you say is recorded and will be used to devalue your claim. Tell them you are represented by counsel or that you are not prepared to give a statement at this time. - Preserve Your “Digital Footprint”
Do not post about the accident on social media. I’ve seen insurance defense teams use a simple photo of a victim smiling at a family dinner to argue that their “pain and suffering” isn’t real. The American Bar Association warns that social media activity is one of the first places defense attorneys look during discovery.
What should I do immediately after an 18-wheeler accident?
- Step 1: Call 911 and request an ambulance and police presence.
- Step 2: Seek medical attention at an ER or Urgent Care within 24 hours.
- Step 3: Record the truck driver’s license and the trucking company’s DOT number.
- Step 4: Contact an experienced truck accident attorney to send a spoliation letter.
- Step 5: Avoid giving any recorded statements to the insurance company.
Jaime’s Perspective
When I was representing the insurance companies, we loved it when a victim waited a few days to see a doctor or gave a recorded statement right after the crash. We called those “gifts.” Those mistakes allowed us to save the insurance company millions of dollars at the expense of someone’s health.
Now that I’m on your side, I don’t let that happen. The first 24 hours are a race. The trucking company is racing to clear the scene and “coach” their driver. I’m racing to make sure your medical needs are documented and that the evidence—like the truck’s Black Box data—is legally frozen in place. My advice? Don’t be “polite” to the insurance company. Be smart. Protect yourself first, and let me handle the giants.
